THE SANCTIONS PARADOX

How much Russian wealth has really been frozen? Where did it go, who still controls it, and why sanctions can be so powerful on paper yet so difficult to enforce in reality — available in English, Italian, Spanish and Russian.

THE SANCTIONS PARADOX

Russian private wealth abroad, frozen assets, enforcement gaps and the hidden architecture of financial sanctions

The sanctions imposed on Russian individuals and entities after the invasion of Ukraine represent one of the largest experiments in modern financial warfare.

The principle appears simple.

Identify the people considered responsible for supporting the Russian political and economic system.

Freeze their assets.

Restrict their access to financial markets.

Prevent them from benefiting from the international financial system.

But after more than four years of war, the most interesting question is no longer whether sanctions exist.

They clearly do.

The real question is:

How much Russian wealth has actually become economically inaccessible?

And an even more uncomfortable question follows:

How can a person be formally sanctioned while members of the same family continue to live internationally, own businesses, hold property and enjoy a lifestyle that appears almost untouched by the sanctions regime?

The European Union currently maintains restrictive measures against around 2,600 individuals and entities under the Ukraine-related sanctions regime. These measures include travel restrictions, asset freezes and prohibitions on making funds or economic resources available to listed persons and entities. (consilium.europa.eu)

But the legal architecture of sanctions and the economic reality of private wealth are two very different things.

1. THE SIZE OF THE RUSSIAN WEALTH PROBLEM

There is no single authoritative number for the total amount of Russian private wealth held abroad.

That is not simply a statistical problem.

It is a structural problem.

Russian wealth accumulated internationally over several decades through:

  • bank deposits;

  • securities;

  • companies;

  • holding structures;

  • real estate;

  • trusts;

  • private-equity investments;

  • family offices;

  • luxury assets;

  • offshore structures.

The owner of an asset may not be the person whose name appears in the official documentation.

A property may belong to a company.

The company may belong to a holding structure.

The holding company may be controlled by a trust.

The trust may have beneficiaries who are different from the formal owner.

The result is a fundamental problem:

legal ownership and economic control are not always the same thing.

2. BANK DEPOSITS AND CAPITAL FLIGHT

Cross-border banking statistics provide some indication of the magnitude involved.

The Bank for International Settlements reported that, during the first quarter of 2022, cross-border liabilities of BIS-reporting banks to Russia almost tripled on a net basis, reaching approximately $68 billion.

The BIS noted that the development was consistent with Russian residents shifting dollar and euro deposits from Russian banks to banks abroad. (bis.org)

This does not mean that $68 billion represented oligarch wealth.

It does not.

It illustrates something more important:

capital can move across borders much faster than governments can redesign the financial rules governing it.

This is one of the fundamental challenges of sanctions policy.

3. REAL ESTATE: THE INVISIBLE BALANCE SHEET

Real estate has historically been one of the preferred stores of wealth for international high-net-worth individuals.

Russian capital has been present in major international property markets for years.

But counting Russian-owned property is extraordinarily difficult.

The critical question is not:

Who is the registered owner?

It is:

Who is the ultimate beneficial owner?

This distinction has become central to sanctions enforcement.

The U.S. Treasury has specifically identified real estate, luxury goods, precious metals and other high-value assets as potential mechanisms for storing wealth and obscuring ownership or evading restrictions. (home.treasury.gov)

The problem becomes particularly complicated when assets are held through relatives or apparently independent companies.

4. THE CHILDREN OF OLIGARCHS

This is perhaps the most politically controversial aspect of the sanctions debate.

Suppose a billionaire is sanctioned.

His bank accounts are frozen.

His property is immobilised.

His company is restricted.

His yacht cannot be freely used or sold.

But his adult child is not necessarily sanctioned.

That child may:

  • have another nationality;

  • live in another country;

  • own independent assets;

  • run a company;

  • hold property;

  • attend an elite university;

  • maintain a high-income lifestyle.

This does not automatically mean that sanctions have failed.

Sanctions are generally individual legal measures.

The difficult question is whether the relative genuinely owns the wealth independently or is acting as a proxy for the sanctioned individual.

The U.S. Treasury has demonstrated that family members can become part of the ownership analysis.

In the case of sanctioned Russian businessman Suleiman Kerimov, for example, OFAC identified a network involving relatives, advisers and opaque legal entities and blocked a Delaware trust containing assets valued at more than $1 billion. (home.treasury.gov)

This is the difference between:

being related to a sanctioned person

and

economically benefiting a sanctioned person.

Those are not necessarily the same thing.

5. FROZEN DOES NOT MEAN CONFISCATED

This distinction is fundamental.

Frozen

The owner generally remains the legal owner, but cannot freely use or transfer the asset.

Immobilised

The asset cannot be freely transferred or otherwise made available.

Confiscated

Ownership itself is transferred under a legal mechanism.

These concepts are frequently mixed together in political debates.

They should not be.

The European Union has immobilised enormous amounts of Russian sovereign assets.

But immobilisation does not automatically mean confiscation.

The EU is instead using the extraordinary revenues generated by immobilised Russian assets to support Ukraine.

In August 2026, the EU announced the receipt of another €1.4 billion in windfall profits generated from immobilised Russian Central Bank assets. The EU stated that the total windfall profits generated since immobilisation had reached approximately €8 billion. (eeas.europa.eu)

This is economically and legally very different from simply taking the underlying principal.

6. WHERE DOES THE MONEY GO?

The basic financial mechanism is:

Russian sovereign assets

↓

immobilisation

↓

interest / extraordinary financial revenues

↓

European financial mechanism

↓

support for Ukraine

The EU currently reports that €3.8 billion in proceeds from immobilised Russian assets form part of the broader European support package for Ukraine, while the total windfall profits generated since immobilisation are now substantially higher. (consilium.europa.eu)

The distinction matters because the principal and the income generated by that principal are legally different assets.

7. WHY SANCTIONS DIFFER FROM COUNTRY TO COUNTRY

There is no single global sanctions police force.

The European Union can establish a common sanctions framework, but implementation and enforcement still involve national authorities.

That creates differences in:

  • beneficial-ownership registers;

  • corporate transparency;

  • banking supervision;

  • real-estate records;

  • licensing;

  • judicial procedures;

  • enforcement resources.

This creates what financial professionals often describe as:

REGULATORY ARBITRAGE

The rules may be restrictive in one jurisdiction and less restrictive in another.

The asset may therefore remain economically valuable even when its original financial environment becomes inaccessible.

This is one reason why sanctions enforcement increasingly focuses on ownership chains rather than simply bank accounts.

8. THE HIDDEN ARCHITECTURE OF SANCTIONS EVASION

This is where the sanctions debate becomes much more sophisticated.

Sanctions evasion is rarely about one magic bank account.

It is generally an architecture.

Authorities have documented recurring structures involving:

Shell companies

Companies with little or no genuine operating activity can obscure who controls an asset.

Nominees and proxies

A person may appear to control property or shares while another person is the real economic beneficiary.

Trusts

Trust structures can separate legal ownership, control and economic benefit.

Family networks

Relatives may become owners, directors or beneficiaries of assets that investigators must then analyse for genuine independence.

Professional intermediaries

Lawyers, accountants, wealth managers, investment advisers and corporate-service providers can become part of the financial infrastructure.

Multi-jurisdictional structures

Companies may be distributed across several countries, making ownership analysis considerably more complicated.

The U.S. Treasury has explicitly identified accountants, investment advisers, wealth-management firms, private-equity firms, lawyers and other financial-service providers as potential enablers in sanctions-evasion and illicit-finance schemes. (home.treasury.gov)

9. A REAL CASE STUDY: THE $1 BILLION TRUST

The Kerimov case illustrates the architecture better than any theoretical explanation.

According to the U.S. Treasury, an investigation uncovered a complex network of relatives, advisers and legal entities.

The assets were held through a Delaware trust.

The trust held more than $1 billion.

Multiple layers of U.S. and non-U.S. shell companies were allegedly used to hold formal title and obscure Kerimov’s economic interest. (home.treasury.gov)

The lesson is important.

The challenge for sanctions enforcement is not simply:

“Find the bank account.”

It is:

Follow the economic control.

10. THE DERIPASKA EXAMPLE

Another case demonstrates how sophisticated purported divestment structures can become.

In May 2024, OFAC announced an action concerning an attempted scheme connected to Russian oligarch Oleg Deripaska involving more than $1.5 billion in shares.

According to Treasury, the proposed structure involved Russian financial-service companies and an investment holding company that held Deripaska’s frozen shares.

Authorities described the arrangement as an example of how supposedly legitimate corporate sales or acquisitions can potentially be abused to disguise continued ownership or control. (home.treasury.gov)

Again, the central issue was not simply the movement of money.

It was:

Who actually controlled the asset?

11. WHICH FINANCIAL INSTITUTIONS HAVE BEEN IDENTIFIED?

It is important to distinguish between naming a financial institution as a sanctioned or investigated entity and accusing an institution of deliberately helping sanctions evasion.

Those are not the same thing.

The U.S. Treasury has, however, publicly designated Russian financial institutions, private-banking executives, wealth-management firms and other financial-service providers in connection with sanctions and sanctions-evasion concerns.

Among the entities identified in Treasury enforcement actions are Russian wealth-management and private-banking structures such as CONFIDERI, Veles Capital and private-banking operations associated with Sberbank, Alfa-Bank and Rosbank. (home.treasury.gov)

Treasury has also designated trust-service providers and other professional intermediaries accused of materially assisting sanctioned Russian elites. (home.treasury.gov)

The correct question therefore is not:

“Which bank can help someone evade sanctions?”

It is:

Which institutions and intermediaries have authorities identified as part of documented sanctions-evasion networks?

That is a very different question.

12. THE REAL WEAKNESS IS NOT A BANK

The most important weakness in the system may be fragmentation.

Imagine a wealthy individual whose financial life is divided between:

Country A — citizenship

Country B — residence

Country C — company

Country D — trust

Country E — property

Country F — bank

Country G — investment vehicle

No single institution necessarily sees the entire picture.

Each institution sees one part.

This is why modern sanctions enforcement increasingly depends on information sharing, beneficial-ownership transparency and cooperation between jurisdictions.

13. DUBAI AND THE NEW GEOGRAPHY OF RUSSIAN WEALTH

The global geography of Russian wealth has also changed.

Traditional European financial centres remain important, but the Middle East and other non-Western financial centres have become increasingly significant.

Dubai has emerged as an important hub for Russian businesspeople and wealthy individuals.

This does not mean that Russian citizens living in Dubai are necessarily evading sanctions.

That conclusion would be unjustified.

It means that geopolitical restrictions have contributed to a reorganisation of where Russian capital, businesses and wealthy individuals operate.

14. THE SANCTIONS PARADOX

The central thesis of this article is simple:

Sanctions can be simultaneously effective and incomplete.

They can:

  • freeze billions;

  • restrict financial transactions;

  • immobilise sovereign reserves;

  • increase compliance costs;

  • isolate designated individuals;

  • restrict access to Western capital markets.

And yet they may not completely eliminate the international lifestyle of extremely wealthy families.

Why?

Because wealth is not simply cash.

It is:

companies + property + trusts + relatives + citizenship + residence + investments + financial intermediaries + jurisdictions.

The sanctions system is therefore not fighting merely against money.

It is fighting against:

FINANCIAL ARCHITECTURE.

15. THE NEXT GENERATION OF SANCTIONS

The next phase of sanctions policy will probably focus increasingly on:

beneficial ownership

family networks

professional enablers

trust structures

cross-border corporate chains

crypto-related infrastructure

alternative payment systems

third-country intermediaries

The EU’s 21st sanctions package adopted in July 2026 further expanded restrictions in financial services and crypto-related sectors, including additional transaction bans involving Russian and third-country financial institutions and crypto-related platforms. (finance.ec.europa.eu)

The direction is clear.

Sanctions are moving from:

“Freeze the person’s bank account”

toward:

“Map the person’s entire economic ecosystem.”

16. THE UNCOMFORTABLE CONCLUSION

The Russian sanctions experience has created one of the largest real-world experiments in financial warfare in modern history.

The results are mixed.

The sanctions have clearly imposed enormous restrictions.

They have immobilised substantial assets.

They have generated billions in extraordinary revenues from immobilised sovereign assets.

They have increased the cost and complexity of international finance for sanctioned individuals.

But the system has also exposed a fundamental weakness:

Wealth is mobile. Ownership is complicated. Jurisdictions are fragmented.

A sanction may identify a person.

But the financial system must identify:

the person + the company + the trust + the family + the beneficial owner + the intermediary + the asset + the jurisdiction.

That is infinitely more difficult.

The ultimate question is therefore not:

How much Russian money has been frozen?

It is:

How much economic control has actually been removed from the sanctioned individual?

That is the question that will define the next generation of sanctions policy.

Congelarne i beni.

  • depositi bancari;

  • titoli;

  • società;

  • holding;

  • immobili;

  • trust;

  • fondi;

  • family office;

  • beni di lusso;

  • strutture offshore.

(home.treasury.gov)

4. I FIGLI DEGLI OLIGARCHI

È uno degli aspetti più controversi.

Un miliardario può essere sanzionato.

I suoi conti possono essere congelati.

I suoi immobili immobilizzati.

  • avere una diversa cittadinanza;

  • vivere in un altro Paese;

  • possedere attività proprie;

  • possedere immobili;

  • gestire una società;

  • studiare in un’università internazionale;

(eeas.europa.eu)

6. DOVE FINISCONO I FONDI?

Il meccanismo può essere rappresentato così:

asset sovrani russi

↓

immobilizzazione

↓

interessi e proventi straordinari

↓

meccanismo finanziario europeo

↓

sostegno all’Ucraina

  • registri dei beneficiari effettivi;

  • registri immobiliari;

  • controlli bancari;

  • procedure giudiziarie;

  • sistemi di licenza;

  • trasparenza societaria;

  • capacità di enforcement.

Questo crea quello che viene definito:

REGULATORY ARBITRAGE

(home.treasury.gov)

Ancora una volta, la domanda fondamentale è:

chi controlla realmente l’asset?

11. QUALI ISTITUZIONI FINANZIARIE SONO STATE IDENTIFICATE?

12. LA VERA DEBOLEZZA NON È UNA BANCA

La maggiore vulnerabilità potrebbe essere la frammentazione.

Un individuo può avere:

cittadinanza in un Paese

residenza in un secondo

società in un terzo

trust in un quarto

immobili in un quinto

conto bancario in un sesto

investimenti in un settimo

Nessuna istituzione vede necessariamente l’intero quadro.

Possono:

  • congelare miliardi;

  • limitare le transazioni;

  • immobilizzare riserve sovrane;

  • aumentare i costi di compliance;

  • isolare determinati individui;

società + immobili + trust + familiari + cittadinanza + residenza + investimenti + intermediari + giurisdizioni.

(finance.ec.europa.eu)

La direzione è evidente:

da

“congelare il conto della persona”

a

“mappare l’intero ecosistema economico della persona”.

persona + società + trust + famiglia + beneficiario effettivo + intermediario + asset + giurisdizione.

Ed è infinitamente più difficile.

La domanda finale non è quindi:

Quanto denaro russo abbiamo congelato?

  • depósitos bancarios;

  • valores;

  • empresas;

  • holdings;

  • inmuebles;

  • trusts;

  • fondos;

  • family offices;

  • activos de lujo;

  • estructuras offshore.

  • tener otra nacionalidad;

  • vivir en otro país;

  • poseer negocios;

  • tener propiedades;

  • administrar empresas;

  • estudiar en una universidad internacional;

(home.treasury.gov)

5. CONGELADO NO SIGNIFICA CONFISCADO

(eeas.europa.eu)

6. ¿DÓNDE TERMINA EL DINERO?

El mecanismo puede representarse así:

activos soberanos rusos

↓

inmovilización

↓

intereses y beneficios extraordinarios

↓

mecanismo financiero europeo

↓

apoyo a Ucrania

  • registros de beneficiarios efectivos;

  • registros inmobiliarios;

  • supervisión bancaria;

  • procedimientos judiciales;

  • licencias;

  • transparencia corporativa;

  • capacidad de enforcement.

Esto genera:

REGULATORY ARBITRAGE

  • congelar miles de millones;

  • limitar transacciones;

  • inmovilizar reservas soberanas;

  • aumentar los costes de compliance;

  • aislar a determinados individuos;

empresas + inmuebles + trusts + familiares + ciudadanía + residencia + inversiones + intermediarios + jurisdicciones.

(finance.ec.europa.eu)

La dirección es clara:

de

“congelar la cuenta de la persona”

a

persona + empresa + trust + familia + beneficiario efectivo + intermediario + activo + jurisdicción.

выявить лиц, связанных с российской политической и экономической системой;

заморозить их активы;

ограничить доступ к финансовым рынкам;

(consilium.europa.eu)

  • на банковских счетах;

  • в ценных бумагах;

  • в компаниях;

  • в холдингах;

  • в недвижимости;

  • в трастах;

  • в инвестиционных фондах;

  • в family offices;

  • в дорогостоящих активах;

Bank for International Settlements

(bis.org)

(home.treasury.gov)

  • иметь другое гражданство;

  • жить в другой стране;

  • владеть бизнесом;

  • владеть недвижимостью;

  • иметь собственные инвестиции;

  • учиться в международном университете;

(home.treasury.gov)

(eeas.europa.eu)

(consilium.europa.eu)

  • корпоративной прозрачности;

  • реестрах бенефициаров;

  • банковском контроле;

  • регистрации недвижимости;

  • судебных процедурах;

  • лицензировании;

REGULATORY ARBITRAGE

trusts

(home.treasury.gov)

Delaware trust.

(home.treasury.gov)

(home.treasury.gov)

Rosbank. (home.treasury.gov)

(home.treasury.gov)

  • заморозить миллиарды;

  • ограничить финансовые операции;

  • иммобилизовать суверенные резервы;

  • повысить стоимость compliance;

  • изолировать отдельных лиц;

trusts

(finance.ec.europa.eu)
